Terms of Use, Consent and Digital Acceptance

1. Purpose

These Terms of Use, Consent and Digital Acceptance ("Terms") govern the use of the electronic registration system provided by Bukan Brasil Academia de Lutas Ltda. ("Bukan"), as well as establish the rules regarding the processing of personal data, the use of the platform, and the administrative relationship between the School and its users.

By completing the electronic registration and providing digital acceptance, the user or, where applicable, the user's legal guardian, declares that they have read, understood, and fully agreed to these Terms.

2. Registration and Accuracy of Information

The user declares and agrees that:

I. All information provided during registration is true, complete, and up to date;

II. They will promptly update their information whenever any changes occur;

III. They acknowledge that inaccurate, incomplete, or false information may compromise the proper functioning of the registration system and the School's records.

Bukan reserves the right to request updated registration information whenever deemed necessary.

3. Information Collected

For administrative, academic, and institutional purposes, Bukan may collect and store the following information, including but not limited to:

• Full name;
• Brazilian Individual Taxpayer Registration Number (CPF), when applicable;
• Residential address;
• Telephone number and WhatsApp contact;
• E-mail address;
• Student photograph;
• Rank or belt level;
• Training history, grading examinations, and other records related to the School's activities;
• Any additional information reasonably necessary for the proper administration of the registration system.

Personal data will be processed in accordance with all applicable data protection laws, including the Brazilian General Data Protection Law (LGPD – Law No. 13,709/2018).

4. Purpose of the Registration

The electronic registration is intended to:

• Identify students;
• Maintain administrative records;
• Manage rank progression and technical history;
• Issue internal records and official documents;
• Organize training sessions, examinations, seminars, and events;
• Facilitate institutional communications;
• Preserve the integrity and accuracy of the School's records.

Personal information will not be used for purposes incompatible with Bukan's institutional activities.

5. Electronic Communications

By accepting these Terms, the user authorizes Bukan to send electronic communications exclusively related to the School's activities, including:

• Training sessions;
• Courses;
• Belt examinations and promotions;
• Seminars and events;
• Administrative notices;
• Institutional news and announcements.

Bukan does not sell or share contact lists with third parties for marketing purposes and will not use personal information for third-party advertising without the user's explicit consent.

Users may request to unsubscribe from institutional electronic communications at any time.

6. Registration of Minors

The registration of minors may only be completed by their parent or legal guardian, who must be at least 18 years of age.

The legal guardian declares that they:

I. Have the legal authority to provide the minor's personal information;

II. Authorize the processing of the minor's personal data in accordance with these Terms;

III. Accept responsibility for the accuracy and completeness of the information provided.

Bukan reserves the right to request documentation proving legal guardianship whenever necessary.

7. Account Use and Security

Users agree to use the registration system and any restricted areas of the website in an ethical, lawful, and responsible manner, consistent with the purposes of the School.

Users shall not:

• Provide false or misleading information;
• Attempt to access another person's account or personal data;
• Perform any action that may compromise the security, integrity, or availability of the platform;
• Use the platform for any unlawful or unauthorized purpose.

Bukan reserves the right to suspend or terminate any registration or account in the event of fraud, misuse, violation of these Terms, or any activity that may compromise the integrity of the School or its systems.

8. Electronic Records and Legal Validity

For security, auditing, and evidentiary purposes, Bukan may retain electronic records relating to the registration process and acceptance of these Terms, including, but not limited to:

• Date and time of acceptance;
• IP address;
• Access logs;
• Other electronic records necessary to demonstrate the user's expression of consent.

Such records may be used for administrative, legal, or regulatory purposes whenever permitted or required by applicable law.

9. Digital Acceptance and Electronic Signature

Acceptance provided through Bukan's website, mobile application, or any other digital platform constitutes a valid and legally binding expression of the user's consent.

The user acknowledges and agrees that:

I. Selecting an acceptance checkbox, clicking an "I Agree" button, or using any equivalent electronic acceptance mechanism constitutes legally valid consent;

II. Such electronic acceptance shall have the same legal effect as an electronic signature and shall be considered equivalent to a handwritten signature where permitted by applicable law;

III. Continued use of the registration system confirms full acceptance of these Terms.

10. Amendments to These Terms

Bukan reserves the right to amend, update, or revise these Terms whenever necessary to reflect operational, technological, legal, or regulatory changes.

The most current version of these Terms will always be made available through the School's official communication channels and website.

Continued use of the registration system after any updates become effective shall constitute acceptance of the revised Terms.

11. Final Provisions

These Terms shall be interpreted together with Bukan's Privacy Policy, which forms an integral part of this agreement.

Any questions regarding these Terms may be submitted through Bukan's official communication channels.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

These Terms shall be governed by the applicable laws of the Federative Republic of Brazil, without prejudice to any mandatory consumer protection laws that may apply.

Final Declaration of Acceptance

By completing the electronic registration process and selecting the acceptance checkbox or any equivalent electronic consent mechanism, the user or, where applicable, the user's legal guardian, declares that they have:

• Read these Terms of Use, Consent and Digital Acceptance in their entirety;
• Fully understood their contents;
• Freely and voluntarily agreed to all provisions contained herein;
• Authorized the processing of personal data in accordance with these Terms and the applicable data protection legislation.

The user acknowledges that this electronic acceptance constitutes a legally valid and binding agreement between the parties.
